Hello Brighton Forest neighbors!
Here's the latest from your newly elected Board of Directors.
Where the new board transition stands
Associa, our management company who acts on behalf of the neighborhood as directed by “The Board”, believes new directors are seated on election day.
That matches our governing documents and the advice the HOA’s attorney gave prior to the October 15 meeting.
However, Associa cannot decide the question itself and must follow the prior Board, which won’t recognize the new directors until January 1.
The 2025 meeting minutes, approved on October 15, included January 1 seating language, which Associa acknowledges conflicts with our governing documents.
Therefore, until January 1, only the prior Board is officially authorized to act for the neighborhood.
We could challenge this in court, since we believe the prior Board is not following our governing documents. However, a court fight would add even more legal expenses to the community’s budget, and we don’t believe that’s in your best interest.
So, while we can’t act on the neighborhood’s behalf yet, we’re using this time to prepare, so we can hit the ground running on January 1.
Our offer to work together
Through Associa, we asked to meet with the prior Board to collaborate and coordinate on any open action items to help ensure smooth transition over the next two months. This includes:
- Open budget questions, especially legal costs that weren't itemized in past budgets and that we've been informed have exceeded $20,000 so far this year
- Property issues, such as Duke Power's work on the tree line
- Seasonal landscaping and holiday plans, including a Santa for Winterfest
The prior Board President responded that: "As long as the lawsuit against the 2026 Board is in place the only communication will be from lawyer to lawyer."
While we respect their decision not to discuss the lawsuit, there’s still plenty of neighborhood business we can work through together outside of any legal matter. Our door remains open.
Since the newly elected board doesn’t want to add to the neighborhood's legal costs, for now, any HOA business must be addressed with the prior Board.
We don't know what they are working on, but our offer to collaborate still stands and we will continue to prepare for our time to officially serve our community.
What we've recently accomplished
- Volunteered at Movie Night and Fall Fest. Thank you to Lauren Hines and the Social Committee for two wonderful events!
- Gained access to TownSq, where we're listed as the Executive Board
- Requested legal invoices from October 2025 - through the remainder of 2026, plus a list of all attorneys working on HOA matters. Ann & Scott to schedule an in-person meeting to review
- Jason Schertzinger built BoardHub to organize documents, meetings, minutes, and action items, and to give future boards a clear record of decisions. A sneak-peak will come in future communications
What we're working on
- A clear record of all HOA and community costs, so our Treasurer can share an accurate financial update
- A homeowner survey, so we can hear what matters most to you for 2027
- Regular updates to keep you informed through the transition
- A plan for regular communications, newsletters, information sharing, etc. for 2027
- Fine tuning the BoardHub to ensure the most efficient and sustainable place for the board to collaborate
We’re so grateful to our committees for everything they continue to do for our community, and we’ll keep volunteering wherever we can lend a hand.
We’re working hard behind the scenes, will keep sharing regular, transparent updates, and look forward to officially serving you as your Board on January 1.
